1. Acceptance of terms
By accessing or using our website, placing an order, or uploading a photo, you agree to these Terms of Service. If you do not agree, please do not use our services.
2. About our service
Moments2Art creates custom portrait artwork based on photographs you provide. We offer digital downloads, framed prints and gallery-wrapped canvas through our online store. Each piece is made to order and reviewed by our studio before delivery.
3. Orders and proof approval
After you place an order, our artists create a digital proof that we send to your email. You must approve the proof before we finalize a digital file or send a physical item to print. You may request revisions within the limits described on the product page. Production times listed are estimates and are measured in business days.
4. Pricing and payment
All prices are listed in USD unless otherwise stated and do not include applicable taxes. We process payments securely through Shopify and its payment partners. Free shipping is offered to the United States and Canada on eligible physical items. You are responsible for providing accurate shipping, billing and contact information.
5. Your photos and content
You must have the right to use and share any photograph you upload. Do not upload content that is illegal, infringing, hateful, obscene or otherwise objectionable. We reserve the right to refuse any order or image that violates these standards or that we cannot reasonably reproduce as artwork.
6. Intellectual property
The final artwork we create is licensed to you for personal, non-commercial use. You may print it, display it and share it for personal purposes. Commercial use, resale or reproduction of the artwork for profit requires our prior written permission. We retain the right to use our artistic process, techniques and any pre-existing designs, and to display anonymized or watermarked versions of completed work in our portfolio unless you ask us not to.
7. Revisions, cancellations and refunds
Because each order is custom-made, our revision and refund policies apply. Please see our Refund Policy for full details. In general, you may request revisions before approving a proof; once a digital file is delivered or a physical item is printed and shipped, cancellations are limited.
8. Shipping and delivery
We ship physical artwork to the United States and Canada. Delivery times are estimates and may vary due to carrier delays, customs processing or weather events. Risk of loss and title pass to you upon delivery to the carrier. Please inspect your package on arrival and report damage promptly.
9. Limitation of liability
To the fullest extent permitted by law, Moments2Art’s liability for any claim related to our services is limited to the amount you paid for the specific order in question. We are not liable for indirect, incidental, consequential or punitive damages, including lost profits or data loss.
10. Indemnification
You agree to indemnify and hold harmless Moments2Art and its team from claims arising out of your use of the service, your uploaded content, or your violation of these terms.
11. Governing law
These Terms of Service are governed by the laws of the jurisdiction where Moments2Art operates, without regard to conflict-of-law principles. Any dispute will be resolved in the courts of that jurisdiction.
12. Changes to these terms
We may update these Terms of Service from time to time. The latest version will be posted on this page. Continued use of our services after changes means you accept the revised terms.
